Article 1 — Purpose and Scope
These Terms set out the conditions for using the LuxRare reservation website (the “System”) provided by LuxRare Co., Ltd. (“we,” “us,” or the “Company”).
Separate Store Terms of Use apply to the use of our stores and equipment. These Terms govern reservation procedures; conduct in the facility, safety management, and other store-use matters are governed by the Store Terms of Use.
Article 2 — Users
A “User” means a person who uses the System to request a first visit or day use, or a member who makes a reservation using a member number issued by the Company.
A representative making a request for other guests must ensure that all guests review these Terms and the Store Terms of Use and provide any required consent.
Article 3 — Agreement to the Terms
First-visit and day-use guests must review and agree to these Terms and the Store Terms of Use each time they submit a request.
Members agree to both sets of terms when making their first reservation in the System. We do not request agreement for every later reservation unless the terms are materially changed.
Article 4 — Requests and Confirmation
A first-visit or day-use request is not confirmed when it is submitted. The reservation is confirmed only after the Company or store reviews it and sends a confirmation notice.
A member reservation is confirmed when the member reviews the details and completes the “Confirm Reservation” action. A reservation may fail if another user secures the seat immediately beforehand.
Article 5 — Reservable Dates and Times
New reservations cannot be made for the current day. The current-day screen is for viewing availability only.
First visits may be requested on or after the next day, on dates and at start times when store staff can assist. Once a first visit begins during staffed hours, its end time is not restricted by staffed hours.
Day use may be requested on or after the next day between 12:00 and 23:59, whether or not staff are present. It is available only to guests who have used LuxRare before and have received an explanation of store procedures.
Next-day member reservations may be subject to a staffed-hour start restriction when staff cannot prepare the reservation sign before the prior-day cutoff. End times are not restricted by staffed hours. Reservations two or more days ahead are not restricted by staffed hours, except for closed days and store blocks.
Article 6 — Member Accounts
Members are responsible for protecting their member number and password and must not lend, transfer, or share them with another person.
Actions completed with a member number and password are treated as actions by that member, except where the Company acts intentionally or with gross negligence. Please contact a store promptly if you suspect unauthorized use.
Article 7 — Reservation Limits and Overlaps
A member may hold up to three future reservations. A member cannot reserve more than one seat during the same time period.
If duplicate reservations arise from a system issue, communication delay, or another cause, we may contact the User to adjust them.
Article 8 — Seat Assignment and Changes
The store assigns seats for first visits and day use. Members may select from the available seats shown in the System.
For store operations, safety, equipment issues, group use, or other unavoidable circumstances, we may ask a User to move or change seats even after confirmation.
Article 9 — Reservation Status and Time
The System does not use check-in or check-out actions. Reservation status changes automatically according to the reserved time.
The reserved period is counted as reservation usage regardless of whether the User actually visits. Please change or cancel promptly if you will not use it.
Article 10 — Changes and Cancellations
Users may change or cancel reservations within the functions and limits offered by the System.
Time may not be returned for a cancellation or reduction made within 24 hours of the reservation start, unless the store approves an exception.
If the store cannot approve a first-visit or day-use request, it will reject the request and notify the registered contact address.
Article 11 — Fees and Payment
No payment is processed through the System. All usage fees and other payments are accepted at the store.
Prices, refunds, membership contracts, and other store-service conditions are governed by the Store Terms of Use, in-store notices, and the applicable plan.
Article 12 — Prohibited Conduct
Users must not submit false information, impersonate others, misuse accounts, unfairly occupy reservation capacity, place excessive load on the System, attempt unauthorized access, analyze or alter the System, or engage in conduct that we reasonably deem inappropriate.
If prohibited conduct is identified, we may cancel reservations, suspend an account, or take other necessary action.
Article 13 — Suspension and Changes to the System
We may temporarily suspend or change all or part of the System for maintenance, faults, network issues, disasters, power outages, third-party service interruptions, or other unavoidable circumstances.
Except in emergencies, important suspensions or changes will be announced through the System or another appropriate method.
Article 14 — Personal Information
We handle personal information collected through the System in accordance with the separately posted Privacy Policy.
Member reservations require only the member’s name. First-visit and day-use requests collect the representative’s name, phone number, email address, and the names of other guests for reservation administration and communication.
The System processes and stores reservation information and checks availability. It does not send reservation details entered by Users to generative AI services.
Article 15 — Responsibility
We make reasonable efforts to provide the System reliably. To the extent permitted by law, we are not responsible for loss caused by a User’s network or device, input errors, failures outside our control, or other causes not attributable to us.
Nothing in these Terms excludes liability for intentional conduct or gross negligence or limits rights that cannot be restricted under applicable law.
Article 16 — Changes to These Terms
We may change these Terms for legal changes, System changes, operational needs, or other reasonable grounds.
We will announce the changes and their effective date through the System. If a change materially affects Users’ rights or obligations, we may request renewed consent.
Article 17 — Governing Law and Discussion
These Terms are governed by Japanese law. If a question or dispute arises, the User and the Company will discuss it in good faith to seek a resolution.
If the matter cannot be resolved through discussion, the court having jurisdiction under applicable law will have jurisdiction in the first instance.
